That wording closely mirrors the definition of synthetically generated information in the IT Rules amendment notified by MeitY on 10 February 2026 (<a href=\"https:\/\/www.meity.gov.in\/static\/uploads\/2026\/02\/550681ab908f8afb135b0ad42816a1c9.pdf\" target=\"_blank\" rel=\"noopener\">consolidated IT Rules<\/a>).<\/p>\n<p>Two practical consequences follow. First, the trigger is realism, not the tool: an obviously animated mascot is unlikely to fall inside the definition at all. Second, text is outside it: the definition only covers audio, visual and audio-visual content, which is why AI-written copy needs no label.<\/p>\n<h2>What must be labelled, what needs no label, and what is banned outright?<\/h2>\n<p>The final guidelines sort synthetic content into three buckets. No label needed<\/h3>\n<ul>\n<li><strong>What ASCI lists:<\/strong> routine edits such as colour correction, light adjustment, noise reduction and standard blemish removal; decorative backgrounds, ambient music and jingles; obvious fantasy; generating ad copy; accessibility uses.<\/li>\n<li><strong>ASCI&#8217;s own examples:<\/strong> a fairy repairing a broken product with magic dust; a car that turns into a flying spaceship; subtitles, closed captions and translations.<\/li>\n<li><strong>What to do:<\/strong> no AI label, but the full ASCI Code still applies.<\/li>\n<\/ul>\n<p>One line in the final text matters more than any list: synthetic content &#8220;may be considered misleading or objectionable regardless of labels, if the end effect is likely to mislead or harm the consumer&#8221; (<a href=\"https:\/\/www.ascionline.in\/wp-content\/uploads\/2026\/09\/Guidelines-for-Responsible-Labelling-of-Synthetically-Generated-Content-in-Advertising.pdf\" target=\"_blank\" rel=\"noopener\">ASCI guidelines<\/a>). A label tells people how an ad was made. It does not make an untrue ad true.<\/p>\n<h2>How do you decide whether your ad needs an AI label?<\/h2>\n<p>ASCI asks advertisers three questions: is the synthetic content central to the ad&#8217;s persuasive message or does it materially influence purchase decisions; would it mislead consumers about the product&#8217;s claims, performance or benefits if it is not labelled; and would the absence of a disclosure create a false or misleading impression (<a href=\"https:\/\/www.ascionline.in\/wp-content\/uploads\/2026\/09\/Guidelines-for-Responsible-Labelling-of-Synthetically-Generated-Content-in-Advertising.pdf\" target=\"_blank\" rel=\"noopener\">ASCI guidelines<\/a>). If not, it is outside ASCI&#8217;s definition, though the ASCI Code still applies to the ad.<\/li>\n<li><strong>Rights.<\/strong> Do you hold written consent for every face or voice, a licence for every copyrighted element, and is every endorsement genuine? If any answer is no, the asset is in the prohibited bucket and a label cannot rescue it.<\/li>\n<li><strong>Relied on.<\/strong> Would a buyer rely on this element when deciding, or form a false impression without a label? Product demos, results, settings that change what the product seems to do, and synthetic people usually pass this test. Colour grading and background skylines usually do not.<\/li>\n<li><strong>Record.<\/strong> If you reach this step, label the element where the viewer will actually see it and keep an evidence file: what was generated, which tool, the consent or licence, the label used and who approved it.<\/li>\n<\/ol>\n<h2>What should brands change before the rules start?<\/h2>\n<p>ASCI&#8217;s chief executive Manisha Kapoor put the burden plainly: &#8220;The responsibility remains with advertisers to ensure that the end communication is honest, transparent and compliant with the ASCI Code&#8221; (<a href=\"https:\/\/www.ascionline.in\/wp-content\/uploads\/2026\/09\/Press-Release_Guidelines-for-Responsible-Labelling-of-Synthetically-Generated-Content-in-Advertising.pdf\" target=\"_blank\" rel=\"noopener\">ASCI press release<\/a>). For most marketing teams that means seven changes.<\/p>\n<ul>\n<li><strong>Inventory your AI use.<\/strong> List every live and planned asset that uses AI faces, voices, product renders, settings or chatbot placements, including always-on performance creative that nobody has looked at in months.<\/li>\n<li><strong>Add an AI field to every brief and approval form.<\/strong> Record what was generated, which bucket it falls in, the label wording and placement, and the approver.<\/li>\n<li><strong>Pick house label wording.<\/strong> ASCI offers &#8220;Audio\/Video created using AI&#8221; and &#8220;Audio\/Video enhanced using AI&#8221;, accepts labels provided by ad platforms, and allows any wording that accurately tells people what is synthetic. Follow ASCI&#8217;s disclaimer guidelines on size and legibility where they apply.<\/li>\n<li><strong>Treat renders as claims.<\/strong> Real estate, automobiles and pre-launch products are exposed here: ASCI&#8217;s own example of a label case is a 3D model of an unbuilt housing complex.<\/li>\n<li><strong>Label paid placements inside AI assistants.<\/strong> If you pay for product suggestions in a chatbot or AI shopping tool, the suggestion must say &#8220;Sponsored by [Brand]&#8221;.<\/li>\n<li><strong>Rewrite talent contracts for digital replicas.<\/strong> Lawyers quoted by exchange4media say consent to AI use should be specific to the actual processing and should cover script approval, duration and what happens if consent is withdrawn (<a href=\"https:\/\/www.exchange4media.com\/digital-news\/ascis-ai-rules-put-creator-consent-and-brand-liability-under-the-spotlight-158737.html\" target=\"_blank\" rel=\"noopener\">exchange4media<\/a>). Any material connection with a brand needs a disclosure label such as Ad, Sponsored, Collaboration, Partnership, Employee, Free gift or Affiliate, or the platform&#8217;s own paid-partnership tool. A virtual influencer &#8220;must additionally disclose to consumers that they are not interacting with a real human being&#8221;, upfront and prominently (<a href=\"https:\/\/www.ascionline.in\/social\/wp-content\/uploads\/2025\/04\/ASCI-Influencer-Guidelines.pdf\" target=\"_blank\" rel=\"noopener\">ASCI influencer guidelines<\/a>). A face or voice that can be replicated is an asset that needs a rights position, monitoring for misuse and a takedown process. That is the work behind our <a href=\"https:\/\/influencepr.in\/talent\/talent-reputation\/personality-rights\/\">personality rights protection<\/a> practice, and it is part of how <a href=\"https:\/\/signd.influencepr.in\/\">SIGND by Influence<\/a> manages careers for performers, athletes and creators.<\/p>\n<h2>How do ASCI&#8217;s rules fit with the government&#8217;s IT Rules on AI labels?<\/h2>\n<p>They answer to different parties. MeitY&#8217;s Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2026, notified on 10 February 2026 and in force from 20 February 2026, place labelling and provenance duties on intermediaries (<a href=\"https:\/\/www.meity.gov.in\/static\/uploads\/2025\/10\/065b6deb585441b5ccdf8be42502a49c.pdf\" target=\"_blank\" rel=\"noopener\">MeitY FAQ<\/a>). Significant social media intermediaries must ask users to declare whether content is synthetically generated before it is published, use technical measures to verify that declaration, and label it (<a href=\"https:\/\/www.meity.gov.in\/static\/uploads\/2026\/02\/550681ab908f8afb135b0ad42816a1c9.pdf\" target=\"_blank\" rel=\"noopener\">Rule 4(1A)<\/a>).<\/p>\n<p>ASCI&#8217;s guidelines, by contrast, are aimed at the advertiser and cover ads in every medium ASCI handles. So a platform may label your content whether or not ASCI would require it, and ASCI accepts platform-provided labels as one way to disclose. MediaNama points out that ASCI does not say whether a label a platform applies on its own will satisfy the brand&#8217;s duty (<a href=\"https:\/\/www.medianama.com\/2026\/10\/223-asci-ai-labelling-guidelines-advertising-2026\/\" target=\"_blank\" rel=\"noopener\">MediaNama<\/a>), so the safe course is to add your own label where ASCI&#8217;s test says one is needed.<\/p>\n<h2>What changed between the May draft and the final rules?<\/h2>\n<p>ASCI released a draft on 12 May 2026 and took feedback until 13 June (<a href=\"https:\/\/www.ascionline.in\/wp-content\/uploads\/2026\/05\/AI-Draft-Guidelines-1.pdf\" target=\"_blank\" rel=\"noopener\">draft press release<\/a>).
